Terms of Service

These Terms of Service ("Terms") govern your use of Black Label Vault ("Service"), operated by Black Label Vault ("we," "us," or "our") at blacklabelvault.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 13 years of age to use Black Label Vault. By creating an account, you confirm that you meet this requirement.

1. Description of Service

Black Label Vault is a web-based sports card collection management platform that provides tools including but not limited to: collection tracking, AI-powered card identification, AI-assisted grade estimation, market value lookup, wishlist management, grading submission tracking, portfolio analytics, and social sharing features.

The Service is offered on a freemium basis with subscription tiers (Free, Pro, and Elite) offering different levels of access to features. Feature availability is subject to the tier you subscribe to.

2. Account Registration

To access most features, you must create an account with a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use at hello@blacklabelvault.com

We reserve the right to terminate accounts that violate these Terms, engage in abuse, or remain inactive for an extended period.

3. Subscriptions and Billing

Free tier: Available to all registered users with limited feature access as described on the pricing page.

Paid tiers (Pro and Elite): Billed monthly via Stripe. Your subscription automatically renews each month until cancelled.

Cancellation: You may cancel your subscription at any time from your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods.

Price changes: We will provide at least 30 days' notice before changing subscription prices. Continued use after a price change constitutes acceptance of the new price.

Payment processing: All payments are processed by Stripe, Inc. We do not store your payment card information. By subscribing, you also agree to Stripe's Terms of Service.

4. AI Features and Disclaimers

Black Label Vault uses artificial intelligence to provide the following features:

• Card identification: AI-powered scanning to identify card details from photos
• Grade estimation: AI analysis of card condition using the PSA 1–10 grading scale
• Market value estimates: AI-generated valuations produced by Claude (Anthropic) from each card’s identifying details (year, player, set, grade, sport) using its pricing-intelligence model
• Portfolio insights: AI-generated analysis of your collection

AI outputs may be inaccurate, incomplete, or outdated. Market values in particular fluctuate rapidly and estimates may not reflect actual current market conditions.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Scrape, crawl, or systematically extract data from the Service
• Attempt to reverse-engineer, decompile, or access the Service's source code beyond what is publicly available
• Use the Service to commit fraud or misrepresent card grades, values, or authenticity
• Interfere with or disrupt the integrity or performance of the Service
• Create multiple accounts to circumvent feature limits
• Share your account credentials with others
• Use the Service for any unlawful purpose

6. Intellectual Property

Our IP: The Black Label Vault name, logo, design, software, and content created by us are owned by Black Label Vault and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Your data: You own the data you input into the Service, including your card collection records, photos, and notes. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your data solely to provide the Service to you.

Third-party trademarks: Card manufacturer names (Topps, Panini, Bowman, etc.), grading company names (PSA, BGS, SGC, CGC), and league names (MLB, NBA, NFL, NHL) referenced in the Service are trademarks of their respective owners. Black Label Vault is not affiliated with, endorsed by, or licensed by any of these entities.

7. Third-Party Services

The Service integrates with third-party services including:

• eBay: The "Find Card on eBay" feature uses eBay's Browse API to retrieve active listings. All eBay API calls are made through our server-side proxy with rate limiting. Black Label Vault is not affiliated with eBay Inc. eBay search results are subject to eBay's API License Agreement.
• Anthropic (Claude AI): AI features are powered by Anthropic's Claude API. Card data (player name, year, set, grade, sport, and card photos for scanning/grading) is sent to Anthropic's API for processing. For market value and insight features, Claude estimates values from the card’s identifying details using its pricing-intelligence model; it does not perform a web search. No personally identifiable information (name, email, account ID) is sent to Anthropic. See our Privacy Policy for full details.
• Supabase: Your account and collection data is stored on Supabase's infrastructure.
• Stripe: Payment processing for subscriptions.

We are not responsible for the availability, accuracy, or terms of these third-party services.

8. Limitation of Liability

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, loss of profits, financial decisions made based on AI estimates, grading outcomes that differ from AI estimates, or any other losses arising from your use of the Service.

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

Data loss: While we take reasonable measures to protect your data, we are not responsible for any loss of data due to technical failures, user error, or circumstances beyond our control. We strongly recommend using the Export to Excel feature regularly to maintain your own backup of your collection data.

10. Account Deletion

You may delete your account at any time from the app sidebar (Delete Account) or by contacting hello@blacklabelvault.com. Upon deletion, your personal data and collection records will be permanently removed from our servers within 30 days. This action cannot be undone.

Deleting your account does not automatically cancel an active subscription. Please cancel your subscription before or after deleting your account to avoid further charges.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes where possible. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update these Terms from time to time. We will notify you of material changes by updating the effective date and, where appropriate, by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Dispute Resolution

These Terms are governed by the laws of the state in which Black Label Vault is operated, without regard to conflict of law principles.

Before initiating any formal dispute, you agree to contact us at hello@blacklabelvault.com and attempt to resolve the dispute informally. Most concerns can be resolved quickly this way.

Any dispute that cannot be resolved informally will be resolved through binding arbitration on an individual basis. You waive the right to participate in a class action lawsuit or class-wide arbitration against Black Label Vault.

13. Indemnification

You agree to indemnify and hold Black Label Vault harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
